These Terms and Conditions (the "Terms") govern the use of the website www.printpaperproduction.com (the "Site"), which is owned and operated by Print.Paper.Production (the "Company").
By accessing and using this Site, you confirm that you have read, understood, and agreed to comply with these Terms. If you disagree with any part of these Terms, you must not use the Site.
Please Note: These Terms contain a Dispute Resolution clause that may impact your legal rights regarding how disputes are resolved. We encourage you to read it carefully.
1. Intellectual Property
All content provided on this Site is the intellectual property of Print.Paper.Production and is protected by applicable copyright and intellectual property laws. This includes, but is not limited to:
Text, images, logos, graphics, videos, and all downloadable materials;
The overall design and layout of the Site;
Any content and features provided on the Site that contribute to its functionality.
You are not authorized to use, copy, distribute, or reproduce any content from the Site without prior written consent from Print.Paper.Production.
2. Acceptable Use
By using our Site, you agree to:
Use the Site only for lawful purposes: You must comply with all local, state, and international laws that apply to the Site and your use of it.
Avoid any illegal activity: Do not use our Site for illegal, fraudulent, or harmful activities, including but not limited to:
Harassing, abusing, or threatening other users;
Infringing upon the intellectual property rights of others;
Attempting to hack, modify, or damage the Site, including accessing someone else’s account without permission;
Engaging in any actions that could be considered fraudulent.
We reserve the right to monitor all activity on the Site. If we determine that you are using the Site in violation of these Terms, we may take the following actions:
Limit or suspend your access to the Site;
Terminate your account and prevent further access;
Take legal action, if necessary, including seeking damages and/or injunctive relief.
3. Limitation of Liability
To the fullest extent permitted by law, Print.Paper.Production, including its directors, employees, affiliates, and agents, shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Site, including but not limited to:
Loss of profits or revenues;
Loss of data or business opportunities;
Any errors, bugs, or downtime on the Site;
Any third-party claims related to your use of the Site.
This limitation of liability applies even if we have been advised of the possibility of such damages.
4. Indemnity
You agree to indemnify, defend, and hold harmless Print.Paper.Production, its directors, officers, employees, and affiliates from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from:
Your use of the Site;
Any violation of these Terms;
Your infringement of any third-party rights.
This indemnification obligation will survive the termination of your use of the Site.
5. Consumer Protection Law
Where applicable consumer protection laws, such as the Consumer Protection Act or other relevant legislation, apply in your jurisdiction, nothing in these Terms will limit or exclude your legal rights under such laws. In case of any conflict between these Terms and applicable consumer protection laws, the legal provisions of such laws will take precedence.
6. Dispute Resolution
If you have any dispute or claim arising out of or relating to these Terms or your use of the Site, you agree to first attempt to resolve the issue informally by contacting Print.Paper.Production. If the dispute cannot be resolved informally, you agree to:
Mediation: You and Print.Paper.Production will attempt to resolve the dispute through non-binding mediation with a neutral third-party mediator.
Arbitration: If mediation fails, the dispute will be submitted to binding arbitration, which will be conducted by an independent arbitrator. The decision made by the arbitrator will be final and binding on both parties.
Small Claims Court: Notwithstanding the above, both parties retain the right to bring a claim in small claims court or pursue actions related to intellectual property infringement.
The costs of mediation and arbitration will be borne by the unsuccessful party.
7. Governing Law
These Terms will be governed by and construed in accordance with the laws of the province of Ontario without regard to its conflict of law principles. Any disputes that cannot be resolved through mediation or arbitration will be subject to the exclusive jurisdiction of the courts in the province of Ontario, Canada.
8. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be deemed severed from these Terms, and the remaining provisions will continue in full force and effect.
9. Modifications to the Terms
We reserve the right to modify or update these Terms at any time to ensure compliance with applicable laws or to reflect changes in our operations. Any modifications will be posted on this page, and the "Effective Date" will be updated accordingly.
You will be notified of significant changes by email or a notice posted on the Site.
